Private hospitals in Ontario and Canada at large are regulated by the provinces and territories. These hospitals can charge above the agreed-upon fee schedule if they are providing non-insured services or treating non-insured persons.
As earlier stated, there have been controversial challenges relating to access to private healthcare in Canada.
For instance, in 2005, the Supreme Court of Canada ruled that the prohibition against private healthcare in Quebec violated the Charter of Rights and Freedoms.
